The judicial officer can assist in the organization of a game or competition as part of a promotional campaign.
The law of July 30, 2002, regulating certain commercial practices, sanctioning ……., having been repealed, it is no longer mandatory to file the rules of any game or competition with a judicial officer.
However, it is strongly recommended to do so. The judicial officer verifies the legality of the competition and, above all, helps to avoid any misunderstandings that the competition might generate, which could ultimately cause more harm to the organizer than the benefits a promotional campaign might bring to their clients.
The judicial officer thus guarantees the compliance (especially with the new GDPR rules) and the fairness of the game rules, from the filing and registration of the rules until the end of the competition.
Filing of the Rules
The judicial officer verifies that your rules include:
- the required details: start and end of the game,
- the precise identity of the organizers,
- the determination of eligible participants and the method of participation,
- details of prizes and their value,
- the methods for determining winners: jury, random draw, tie-breaker questions,…
The judicial officer, having carried out the verifications, draws up a statement of fact regarding the filing.
Random Draw
The judicial officer can ensure the monitoring of operations throughout the duration of the game to guarantee its compliance with the filed rules.
To designate the winners, as provided by the rules, the judicial officer can conduct the random draw personally or attest, by their presence, to its regularity.
